Solid Waste Management Rules, 2026 notified; four-stream segregation mandatory from 1 April 2026
The Environment Ministry notified the Solid Waste Management Rules, 2026 under the Environment (Protection) Act, 1986, replacing the 2016 rules; they make four-stream segregation at source mandatory and come into force on 1 April 2026.
Summary
The Ministry of Environment, Forest and Climate Change notified the SWM Rules, 2026 on 28 January 2026, superseding the SWM Rules, 2016. The rules integrate circular economy and Extended Producer Responsibility principles. Waste must be segregated at source into four streams: wet, dry, sanitary and special care waste. Bulk Waste Generators are defined as entities with a floor area of 20,000 sq m or more, water use of 40,000 litres a day or more, or waste generation of 100 kg a day or more; they account for nearly 30% of solid waste and come under a new Extended Bulk Waste Generator Responsibility (EBWGR). Environmental compensation will be levied on the 'polluter pays' principle: CPCB will frame guidelines and State Pollution Control Boards/Committees will levy it. The whole SWM process will be tracked online.
