Summary

The Supreme Court on 17 August 2026 directed all States to constitute a special dedicated Special Investigation Team (SIT) at the State level to probe suspected fraudulent motor accident insurance claims. The bench of Justice Ahsanuddin Amanullah and Justice Prasanna B. Varale passed the order in The Oriental Insurance Co. Ltd. v. Tuni Pati, after finding a pattern in which the same vehicle was shown as involved in multiple accidents. Insurance companies must forward all fraud-indicative claims to the SIT, and their top management will be held accountable for any selective forwarding. Where a Motor Accident Claims Tribunal (MACT) rejects a claim for fraud or collusion, the insurer must send the details to the State SIT and run an in-house inquiry into collusion by its own officers. The order recorded that Uttar Pradesh had received 2,188 complaints and lodged 231 FIRs against 533 accused.
